However, it is often preferable to obtain a written agreement simply because it is much more difficult and expensive to prove the existence and terms of an oral contract than a written contract. In the example above, if you had to go to court to get the $100, your neighbor could say he offered $10, not $100, or he could easily deny that he would ever pay. An experienced lawyer assists you from start to finish in the contract design and verification process and protects you from complications, mistakes or misunderstandings. In addition, they will help avoid further legal problems arising from a poorly written contract and will represent you in court if necessary. In addition to their legal skills, contract lawyers are also detailed and excellent problem solvers. If you have your legal documents prepared by a lawyer, you will have an outside perspective on your business relationship. Sometimes the people involved are too close to the negotiations to notice any problems with the structure of the agreement. Before you look at why you should let a lawyer design a contract for you, it would be helpful to discuss contracts in general. Quite simply, a treaty is a promise or a series of promises that the law will enforce. See Pollock, Pollock`s Principles of Contract, xliv, 610 (13th edition 1950). With a handful or certain exceptions, contracts do not need to be in writing.
Another problem is that these templates do not take into account the peculiarities of your situation. No two people or companies are exactly equal. If you use a form contract, you may encounter serious difficulties in the event of a contractual dispute.
